California Affirms Right of Illegal Aliens for Reduced College Tuition

You know, as each day goes by, I’m left scratching my head.  The problem of course, besides the fact that I’m starting to scratch a hole in my head is the fact that I apparently have no real understanding of how the legal or judicial system works in the “golden” state.  Just today, the California State Supreme Court ruled that “illegal immigrants are entitled to the same tuition breaks offered to in-state high school students to attend public colleges and universities.” [1]

You may wish to read that again, especially the part where it says that they are entitled to the same tuition breaks.”  They are entitled? That leaves me at a complete loss.  So, it does not matter that they are here in this country illegally, which means they are breaking the law by being here (which makes them criminals).  In spite of that obvious problem, apparently it is not a problem as far as the California State Supreme Court is concerned.

This reminds of the case I heard about years ago where a woman was being raped by an unknown assailant.  During the commission of the rape, the woman pleaded for the rapist to use a condom (so that she would not get pregnant or get a sexually transmitted disease).  In court, it was determined by the judge that since the woman stopped and asked the rapist to put on something to protect her, the judge decided that from that point on, it became consensual sex, not rape.  The implication of course is that it would have been better for the woman to just “go with it,” and take what she gets so that the rapist  would have been convicted of rape.  This makes little sense to me, but what do I know?

You can probably see my confusion here with the idea that people who are here illegally are entitled to anything.  In fact, I’m not the only one.  At the bottom of the news page, there was a poll and out of35,286 people who took the poll, a whopping 92% said NO to the following question: Should illegal immigrants be eligible for in-state tuition rates? There were 7% who said they should be able to, and 1% were undecided.

The article went onto say, “The state law also requires illegal immigrants who apply for the in-state tuition to swear they will attempt to become U.S. citizens. The applicants are still barred from receiving federal financial aid.” [2]

The court noted that the problem was that the statute does not say anything about residency, but it was determined that the law is in violation of the Constitution and/or Congressional law.

Mark G. Yudof, President of University of California stated, “Through their hard work and perseverance, these students have earned the opportunity to attend UC.  Their accomplishments should not be disregarded or their futures jeopardized.”

I’m not sure how Yudof believes that they students should be rewarded for their perseverance and why it should be assumed that they should step ahead of thousands of other legal residents of this state who are also trying to get accepted into the UC system.

I’m really sorry, but it just appears to me that people are either becoming more ridiculous daily, or I’m just completely out of touch with things.  Then again, we wonder why California is pretty much bankrupt…
