Aw Tsk, Tsk, Federal Judge Rules Part of Obama Care Unconstitutional

I wasn’t aware that any Federal judges had it in them, but there appears to be one who is willing to place his career on the line by standing up against the Obama Administration, and for the United States Constitution. I should probably clarify my point to acknowledge that Federal judges appointed to their respective benches by conservative presidents like George W. normally support the U.S. Constitution, while those appointed by leftwing liberal nut jobs don’t. Their response is something akin to “The U.S. Constitution? What’s that? Isn’t that the document created by those right-wingers?” Yes, it was and in fact, this country was actually founded by right-wing “nuts” who were desperately trying to get out from underneath the overbearing nature of England’s monarchical rule. They succeeded only to be hounded by them.
When this country finally became established, conservatism ruled the day. Over time, as we know, more liberal crackpots have gotten their voices into the mix and have continually attempted to redact the meaning of the U.S. Constitution and the Bill of Rights (or parts of them).
Just today, I learned that one of the Supreme Court Justices has decided that our founding fathers would have approved of limits on gun rights. Really? Funny that they did not put that anywhere in the U.S. Constitution or Bill of Rights. They simply said that we the people have the right to bear arms. It’s called the 2nd Amendment and while every liberal opposed to this amendment wants it to mean something else, it means that I have the right to bear arms, period.
Getting back to our topic at hand regarding a strike against Obama’s health care plan, “U.S. District Judge Henry Hudson, appointed to the bench by President George W. Bush in 2002, backed arguments by the state of Virginia that Congress exceeded its authority by requiring that individuals buy health insurance by 2014 or face a fine.” [1]
Isn’t that wonderful? So, in other words, the Federal Gov’t cannot force citizens of the United States to buy health insurance. Wow, who would have thought that the Federal gov’t has limitations, in spite of the fact that the Federal gov’t acts as though it has no limitations.
The reality is that the Federal gov’t was created as a form of support for the states of this country. The branches of the Federal gov’t were not created in order to dictate to the states, but to support and protect them. Those on the left disagree with this, but that’s like those who approach Scripture using allegory as their main tool for interpretation.
The truth of the matter is that language is not that complex. If the original language and thoughts are allowed to be kept within the framework of their original context, it is surprising how clear meaning becomes.
Judge Henry Hudson continued, “The Minimum Essential Coverage Provision is neither within the letter nor the spirit of the Constitution,” Hudson wrote in a 42-page decision. However, he declined to invalidate the entire healthcare law, a small victory for Obama.” [2]
Of course, it goes without saying that the Obama Administration will appeal the decision and there is a good chance it will go to the Supreme Court. My concern is with newly appointed Supreme Court Justices Kagen and Sotomayer as well as a few other liberal justices, they will support Obama simply because of politics and not because of the Constitution. This is especially true since both Kagen and Sotomayer have indicated that they have little to no problem with using International law in decision-making. This of course, sets aside the U.S. Constitution, allowing other systems of law to trump it. In my mind, except under martial law, setting aside the U.S. Constitution seems to be treasonous, but hey, what do I know? I’m just one of those right-wing loons.
The article went onto say: “The Obama administration will likely appeal as the law has become a cornerstone of Obama’s presidency, aiming to expand health insurance to cover millions of uninsured Americans while curbing costs.
“The healthcare industry opposed Obama’s reform but insurers, which include companies such as Aetna Inc and WellPoint Inc, favor the individual mandate as it means more customers.” [3] (emphasis added)
Interesting how companies like Aetna favor the law, yet because of Obama Care have raised my premiums and co-pays just recently, and have already stated that they will do so again in 2011.
I’m also not sure how guaranteeing health coverage for everyone reduces costs, but apparently the Obama Administration is seeing something I’m not. If we consider that over 120,000 jobs within the healthcare industry have been lost due directly to Obama’s healthcare package, maybe that’s what he means by reducing costs. In other words, fewer jobs means less costs within health care. Who knows how President Obama thinks. In fact, it is doubtful he thinks at all, but merely parrots what his superiors tell him to do.
I agree with Judge Hudson who says that this dispute over this health care package has to do with the government forcing Americans to buy something. That has never been part of the picture before, so it certainly seems clear that the Feds have overstepped their boundaries, though that is not the first time and it surely will not be the last.
If the Obama Administration wanted to help the average American, they would focus on overhauling the insurance industry first. This alone would create savings for the average consumer. After this has been dealt with (which will not happen over night), then and only then could the issue of health care for all be taken up.
“Congress must obey the Constitution rather than make it up as we go along. Liberty requires limits on government, and today those limits have been upheld,” said Republican Sen. Orrin Hatch, a longstanding critic of the individual coverage mandate.” [4]
The Federal government under President Obama seems to be unaware that citizens in this country have freedom (liberty). In fact, he, the DOJ, DHS, TSA, and others act as if we are at their beck and call. They want to reduce our freedoms to virtually nothing. Once again, this is an example of how the Federal government is attempting to maneuver its way into the homes, bedrooms, and doctors’ offices of American citizens. It needs to stop and hopefully if nothing else, it will be seriously curtailed.
